About this policy

This acceptable use policy sets out the standards that apply when you use omniacapitalgroup.com (the "site"), submit an enquiry, or send us any material. It forms part of, and should be read with, our Terms of Use. By using the site you agree to this policy.

We may update this policy from time to time. The version in force is the one published on the site, so please check it periodically.

Prohibited uses

You may use the site only for lawful purposes. You must not use it:

  • In any way that breaches any applicable law or regulation, or that is fraudulent or has any fraudulent purpose or effect.
  • To send, knowingly receive, upload or use any material that does not comply with the content standards below.
  • To transmit unsolicited or unauthorised advertising or promotional material, or any other form of similar solicitation (spam).
  • To send any data that contains a virus, trojan, worm, or any other harmful program or code designed to disrupt or damage software or hardware.
  • To gain or attempt to gain unauthorised access to the site, the server on which it is stored, or any server, computer or database connected to it.
  • To attack the site through a denial-of-service attack or a distributed denial-of-service attack.
  • To collect data from the site by automated means (such as scraping, harvesting, data-mining or bots), or to submit forms by automated means, without our written consent. This does not restrict public search-engine crawlers acting in line with our robots rules, assistive technologies, or any other access we permit.
  • To impersonate any person, or misrepresent your identity or affiliation with any person.

Content standards

These standards apply to any material you contribute through the site, including the details you put in an enquiry form or send us by email. Contributions must be accurate where they state facts, genuinely held where they state opinions, and must comply with the law. Contributions must not:

  • Be defamatory, obscene, offensive, hateful or inflammatory, or promote violence or discrimination.
  • Infringe any intellectual property right, or any right of confidence or privacy, of any other person.
  • Be misleading, or be likely to deceive or defraud any person.
  • Promote any unlawful activity, or threaten, abuse or invade the privacy of another person.
  • Harass, intimidate or threaten any person, including our staff and representatives.
  • Contain material that sexually exploits or endangers children, or is otherwise harmful to minors.
  • Include the personal data of any other living person unless you have their consent or another lawful basis to share it with us.

Action we may take

Where we reasonably believe a breach of this policy has occurred, we may take whatever action we consider appropriate and proportionate to the breach. Depending on its seriousness, this may include one or more of the following:

  • Immediate, temporary or permanent withdrawal of your right to use the site.
  • Removal of any material you have submitted.
  • Issuing a warning to you.
  • Taking legal proceedings against you to recover the reasonable costs and losses we incur as a result of the breach, where we are entitled to do so by law.
  • Disclosure of information to law enforcement authorities where we reasonably consider it necessary or as required by law. Any disclosure of personal data will be made in accordance with our Privacy Policy and applicable data-protection law.

This list is not exhaustive, and we may take any other action we reasonably consider appropriate and proportionate in the circumstances. Except for any liability that cannot be excluded or limited under applicable law, we are not liable for loss arising from action we take in good faith in response to a breach of this policy; this is subject to the limitations in our Terms of Use.
